Saudi Arabia's Ministry of Human Resources has set out the conditions for transferring the services of an expatriate worker from a company to an individual.

The ministry explained that the requirements include, firstly, that the worker’s permit must be valid and the job must fall under domestic occupations.

Additionally, the worker must not be employed in high-level professions, such as teaching, technical, medical, specialist roles, or jobs restricted to Saudis.

Transferring a worker without employer approval

The Ministry of Human Resources and Social Development previously confirmed that a worker may be transferred from a company without the current employer’s consent if the worker’s permit and residency have expired.

It also clarified that transferring service or changing a worker’s profession from an individual to a company is currently unavailable.

The ministry added that a worker can be transferred from a company without the employer’s approval in the following cases: if the worker’s permit and residency have expired, if wages have not been paid for three consecutive months, or if a malicious absence report against the worker is proven.
